When is a prior consent for electronic mail not necessary?
A prior consent for electronic mail is exceptionally not necessary if the following five conditions are met:
- the sender has received the contact information for the message related to the sale or service to his customers and
- the message is for direct mailing for your own similar products or services and
- the customer has been given the opportunity to receive such messages when collecting and
- free and easy to refuse at every transmission and
- the customer did not refuse the delivery in advance. In particular, it may not be sent to recipients who are entered in the so-called "ECG list." This list is kept by the Regulatory Authority for Telecommunications and Broadcasting (www.rtr.at/ecg) and must always be observed by the sender if no consent has been given.
Attention! This exception applies only to electronic mail (eg e-mails and SMS) but not to telephone calls and faxes. For them, the approval requirement applies without restriction. |
